ABSTRACT: This study aims, through an interdisciplinary literature review, to identify the regimes of femininity present in cases of domestic violence against women within the Brazilian judicial system. Characterized as matrices of intelligibility for moral or legal recognition (or the lack thereof), these regimes operate in a way that conditions credibility, protection, and the production of hierarchies of victimization. Using a qualitative approach, the study is evidence-based and supported by the Consensus tool. In conclusion, it finds that legal discourse, while purporting to be protective, also reproduces gender stereotypes, highlighting the need for legal literacy and anti-discriminatory legal practice grounded in Brazilian legislation.
