  ABSTRACT: The pursuit of economic interests must not undermine sustainable development, one of the pillars of which is respect for the environment. The mining sector contributes to economic growth through spin-offs from mining activities. The Constitution of Burundi advocates the rational management of natural resources. This management must not negate the right to a healthy environment. Laws have been enacted to respect, protect and implement this right, in particular the Mining Code. Derived from the Constitution and the Environmental Code, its purpose is to promote mining activities without compromising the right to a healthy environment. An analysis of this code leads to the conclusion that the environment is a sensitive issue and that a series of legal mechanisms are in place to protect it.
