  ABSTRACT: This essay analyzes the intersection between Constitutional Law and Music Education, highlighting the importance of ensuring the right to music education in Brazilian schools. It examines the role of the Executive, Legislative, and Judiciary powers in the formulation, implementation, and oversight of public policies aimed at music education. Through a comparative analysis of different constitutional systems, it identifies effective practices and challenges in promoting music teaching, considering aspects such as financing, teacher training, curricula, and infrastructure. The essay emphasizes the need for an interdisciplinary and intergovernmental approach to overcome obstacles in realizing this right, proposing guidelines to improve educational policies in the field of music. It concludes that music education should not be seen in isolation, but as an integral part of human, cultural, and social development, requiring a commitment to the principles of equity, quality, and democratic governance.
